■ زمانی که گفت‌وگوهای هسته‌ای شما با دولتمان را مشاهده کردیم، به این نکته رسیدیم که احتمالاً، شما به صورت دقیق متوجه سیستم مبتنی بر قانون اساسی ما نشده‌اید. بنا بر این، توجه شما را به دو مورد از ویژگی‌های قانون اساسی‌مان جلب می‌کنیم: قدرت ایالات متحده در به وجود آوردن توافقنامه‌های بین‌المللی الزام‌آور و ویژگی‌های متفاوت مسؤولان دولت فدرال که حتماً باید در مذاکرات هسته‌ای به آن توجه داشته باشید:
• اول، براساس قانون اساسی، زمانی که رئیس‌جمهور در حال مذاکره درباره توافق‌های بین‌المللی است، کنگره نقش مهمی در تصویب این توافق‌ها دارد. درباره پیمان‌نامه‌ها حداقل دو سوم نمایندگان باید پیمان را به تصویب برسانند. موافقت اجرایی کنگره برای اجرای پیمان‌نامه‌ها و معاهدات نیز باید هم به تصویب سنا برسد، و هم مجلس نمایندگان (که این مسأله به معنای این است که حداقل سه‌پنجم نمایندگان سنا باید به این توافق‌ها رأی داده باشند). هر چیزی که توسط کنگره به تصویب نرسیده باشد، قابلیت اجرایی ندارد.
• دوم، مسؤولان در قانون اساسی ویژگی‌های متفاوتی دارند. برای مثال، رئیس‌جمهور ممکن است فقط برای یک دوره ۴ ساله انتخاب شود و این در شرایطی است که سناتورها می‌توانند برای مدت نامحدودی در دوره‌های ۶ ساله برای مجلس سنا انتخاب شوند. همان طور که هم‌اکنون، نیز قابل مشاهده است. برای مثال، رئیس‌جمهور اوباما در ژانویه سال ۲۰۱۷ میلادی سمت خود را ترک خواهد کرد این در شرایطی است که بسیاری از ما (نمایندگان سنا) برای دوره‌های متمادی و نامحدود و شاید چندین ده ساله در سنا خواهیم بود. معنای این چشم‌اندازهای قانون اساسی این است که هر توافقی درباره برنامه سلاح‌های اتمی شما که مورد تأیید کنگره قرار نگرفته باشد، تنها توافقی اجرایی با باراک اوباما خواهد بود. رئیس‌جمهور بعدی می‌تواند چنین توافقی را تنها با یک امضا از اساس رد کند و کنگره می‌تواند شرایط قرارداد را به نحوی که می‌خواهد تغییر دهد. ما امیدواریم این نامه دانش شما درباره سیستم قانون اساسی را افزایش داده و درک دوطرفه و شفافیت در پروسه گفت‌وگوهای هسته‌ای را تقویت کند.

An Open Letter to the Leaders of the Islamic Republic of Iran:
It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system. Thus, we are writing to bring to your attention two features of our Constitution—the power to make binding international agreements and the different character of federal offices—which you should seriously consider as negotiations progress.
First, under our Constitution, while the president negotiates international agreements, Congress plays the significant role of ratifying them. In the case of a treaty, the Senate must ratify it by a two-thirds vote. A so-called congressional-executive agreement requires a majority vote in both the House and the Senate (which, because of procedural rules, effectively means a three-fifths vote in the Senate). Anything not approved by Congress is a mere executive agreement.
Second, the offices of our Constitution have different characteristics. For example, the president may serve only two 4-year terms, whereas senators may serve an unlimited number of 6-year terms. As applied today, for instance, President Obama will leave office in January 2017, while most of us will remain in office well beyond then—perhaps decades.
What these two constitutional provisions mean is that we will consider any agreement regarding your nuclear-weapons program that is not approved by the Congress as nothing more than an executive agreement between President Obama and Ayatollah Khamenei. The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.
We hope this letter enriches your knowledge of our constitutional system and promotes mutual understanding and clarity as nuclear negotiations progress.
